I wouldn’t sue them (too much effort, too expensive, not worth the trouble, etc.)
But I would not send my kid to that day care any more and I would inform other mothers of the incident.

Why is a lawsuit the first thing to do any almost any situation these days. I read only the other day that a man is suing the makers of Lynx body spray because he failed to attract women like the men in the ads do. So, no, I wouldn’t sue, but the I would be removing my child and making sure everyone else knows about it.

he wasnt just sunburned he was severely sun burned
I would make them pay for his medical care
Your suposed to be watching the children ..if you were watching at all you would have seen the kid cooking

To successfully sue you have to be able to prove damages…in a situation where a child is badly sunburnt they are in pain for a little while but there should be no permenant injury after just one sunburn so I doubt you would be able to sue.

Down the track, if that child were to get melanoma you would then have to prove that the child havd NEVER been sunburnt on any other occasion & had not been exposed to tanning beds…almost impossible to do I would think.

I wouldnt sue but I would remove my child from their care immediately & make sure I reported the centre to DoCS!!!!!

It seems in this case it was an issue of neglect.

If a child was so badly burned they blistered and needed emergency care, then there’s a problem. It’s not like this child turned a little pink. Just like if you saw a child playing with a broken piece of glass or in a bucket with water in it, you’d have to intervene. When you see a child getting terribly sunburned you get them out of the sun.

Whoa, whoa, whoa. Getting a sunburn is abandonment now? It should be the parent’s job to apply 12+ hour sunblock to their kids not the day care’s.

Yes I would. You take your child to a day care to be looked after not abandoned and abused.

no, i wouldnt sue unless my kids like severly hurt. its irresponsible to let a daycare child get sunburnt tho. they should be keeping better eyes on the kids
